While verbal agreements are technically valid, the Residential Tenancies Act strongly recommends a written agreement. Since 2004, landlords are required to provide tenants with a rent book or written statement of the tenancy terms. A comprehensive written agreement protects both parties and is essential for any dispute resolution through the RTB.
Since 1 March 2026, the former Rent Pressure Zone system has been replaced by national rent control. Rent increases are now capped at the lower of CPI (Consumer Price Index) or 2% per year, applied to all private tenancies nationwide. For new-build apartments with a commencement notice after 10 June 2025, increases follow CPI only (the 2% cap does not apply). Our agreement automatically includes the correct rent review clause based on whether the property is a new build or not.
Yes. All private residential tenancies must be registered with the Residential Tenancies Board (RTB) within one month of the tenancy commencing, and renewed annually thereafter. The registration fee is EUR 40 per year for online registration. Since March 2026, rent review notices must also be sent to the RTB at the same time as the tenant, at least 90 days before the new rent takes effect. Notice periods depend on the length of the tenancy and are set by the Residential Tenancies Act. For tenancies created from 1 March 2026, the new Tenancy of Minimum Duration (TMD) rules apply - these are 6-year rolling tenancies with restricted termination grounds, particularly for large landlords (4+ tenancies). The grounds on which a landlord can end a TMD during the 6-year term are more limited than before.
