This document is a General Power of Attorney, which is valid only while you have mental capacity. For an Enduring Power of Attorney (EPA) - which continues if you lose capacity - you must use the Decision Support Service (DSS) forms and involve a solicitor and GP, as required by the Assisted Decision-Making (Capacity) Act 2015.

A General Power of Attorney is valid only while you have mental capacity. If you lose capacity (for example, due to dementia or a serious accident), the General POA is automatically revoked. An Enduring Power of Attorney (EPA) continues to operate even if you lose capacity. Since April 2023, EPAs must be created using Decision Support Service (DSS) forms and require solicitor and GP certification under the Assisted Decision-Making (Capacity) Act 2015. EPAs must be created through the Decision Support Service (DSS) at decisionsupportservice.ie. The process requires DSS-generated forms, certification by a solicitor that you understand the implications, certification by a GP that you have mental capacity, and notification to your spouse and adult children.
