Free employment contract templates for Ireland are everywhere. But employment law has changed dramatically in 2025 and 2026 - auto-enrolment pension obligations, the Karshan employment status test, remote working rights, and retirement age changes. A template that was adequate in 2023 is a liability in 2026.
Why Free Templates Are Risky
No auto-enrolment provisions
My Future Fund went live on 1 January 2026. Every eligible employee must be auto-enrolled. Free templates drafted before 2026 have no pension provisions, leaving you in breach of your statutory obligations from day one.
Karshan employment status risk
The Supreme Court's Karshan decision changed how employment status is assessed. Your employment contract should clearly establish employee status with provisions consistent with the five-step test. Free templates use generic language that may not protect you if Revenue questions the arrangement.

When to Use a Solicitor Instead
Consider using a solicitor if the role involves complex restrictive covenants (senior executives in regulated industries), share option schemes, secondment arrangements, or if the employee is relocating from another jurisdiction. For standard Irish employment contracts covering salary, hours, leave, notice, and the 2026 auto-enrolment provisions, a self-service document is fully adequate.
